These Terms of Service (the "Terms") set forth the conditions for providing PasoPaso (the "Service") and the rights and obligations between users (each a "User") and us regarding use of the Service. Users shall use the Service after agreeing to these Terms.
Article 1: Accounts and Eligibility
- 1.1 Account creation: Users may access certain features by creating an account through an external ID provider approved by us (Apple, Google, X, GitHub, etc.). Users are responsible for managing their own credentials.
- 1.2 Guest use: The Service may offer guest use without creating an account. Data during guest use is stored on the device and may not carry over after reinstalling the app or changing devices. Purchases and restores of the paid plan are not available during guest use.
- 1.3 Previously suspended accounts: We reserve the right to refuse registration by, or to terminate the existing account of, any User whose account has previously been suspended or terminated for violating these Terms or otherwise.
- 1.4 Accuracy of information: Users shall keep their account information accurate and up to date.
Article 2: Description of the Service
The Service is an app that, based on behavioral science, supports breaking down goals (Goal), milestones (Milestone), and tasks (Todo) and managing progress. Where applicable, it provides AI task generation (using the OpenAI API). Data storage and authentication are performed using Supabase.
- Free plan: A plan available at no cost. Certain limits apply, such as the number of goals that can be created and the number of times AI task generation can be used.
- Plus plan (paid subscription): A paid plan. The limits of the Free plan are relaxed or removed, such as removing the limit on goal creation and the monthly limit on AI task generation.
We may change plan features, benefits, and usage limits from time to time as we improve the Service.
Article 3: License to Use the Service
We grant Users a non-exclusive, revocable, non-transferable, and limited license to access and use the Service in accordance with these Terms. Except to the extent permitted by applicable law, Users shall not:
- copy, modify, or reverse engineer the Service's software or source code, or create derivative works based on them;
- resell the Service (except where we have expressly permitted it); or
- develop competing products or use the Service for unlawful purposes.
Article 4: Subscriptions, Fees, and Payment
- 4.1 Fees and billing cycle: Fees for the Plus plan are charged in advance for the selected period (monthly or yearly). Monthly and yearly differ only in billing cycle; there is no difference in available features.
- 4.2 Auto-renewal: The Plus plan is an auto-renewing subscription. Unless canceled before the end of the current subscription period, it renews automatically at the same term and price, and the renewal fee is charged to the User's payment method shortly before the end of each period.
- 4.3 Payment processing: The Plus plan is an auto-renewing in-app purchase sold through the Apple App Store or Google Play. Payment and billing are handled through each store's systems, and we do not retain payment information such as credit card details.
- 4.4 Account-based entitlements and purchase restoration: Plus entitlements are tied to the User's PasoPaso account, not to a device or store account (Apple ID / Google account). A purchase is valid only for the PasoPaso account that made it. Restoring a purchase is an operation that re-synchronizes the subscription status of that account when signed in with the same PasoPaso account used at purchase; even if the same store account (Apple ID or Google account) is shared, purchases and entitlements cannot be transferred to a different PasoPaso account. Purchases and restores are not available while signed out or using the app as a guest.
- 4.5 Fee and price revisions: Fees for the Plus plan are as displayed on the purchase screen of the App Store or Google Play. Displayed prices may vary by country/region and over time due to exchange rates, taxes, store settings, and other factors. We may revise fees; if we make a material price change affecting ongoing subscriptions, we will announce it by appropriate means before it takes effect and, where necessary, follow the procedures prescribed by the stores (such as obtaining renewed consent).
- 4.6 Cancellation, expiration, and grace periods: Users may cancel auto-renewal at any time from the subscription management screen of the App Store or Google Play they use. After cancellation, the Plus plan remains available until the end of the current subscription period. If a subscription expires, lapses, or is revoked, the User returns to the terms of the Free plan. If a store provides a payment grace period due to delayed payment or otherwise, we may maintain access to the Plus plan during that period.
- 4.7 Refunds: Refunds and cancellations of purchases are, in principle, governed by the terms and procedures of the App Store or Google Play, and whether a refund is granted is at each store's discretion. Except where required by law, we do not provide individual refunds for purchases made through the stores.
Article 5: User Content and Intellectual Property
- 5.1 Your content: Rights to the content Users enter, such as goals, milestones, and tasks ("User Content"), belong to the User. User Content is stored on Supabase for storage and synchronization.
- 5.2 Handling for processing: We handle User Content to the extent necessary to provide, improve, and troubleshoot the Service. When AI features are used, the goals, milestones, descriptions, deadlines, and other information the User enters or specifies may be sent to a third-party service (OpenAI). See the Privacy Policy for details.
- 5.3 Our intellectual property: Intellectual property rights in the programs, documentation, logos, algorithms, and other elements of the Service belong to us or to our licensors. Except for the license granted in these Terms, no rights are granted.
Article 6: Prohibited Conduct
In using the Service, Users shall not engage in any of the following:
- Conduct that violates laws or public order and morals
- Conduct that infringes the rights of others (intellectual property, privacy, etc.)
- Conduct that interferes with the operation of the Service or places excessive load on it
- Unauthorized access, misuse of credentials, or impersonation
- Creating multiple accounts to circumvent usage limits, or other improper use
If a violation is found, we may suspend or delete content or accounts.
Article 7: Privacy
Use of the Service is subject to our Privacy Policy. Please refer to that policy for how personal information and usage data are collected, used, and protected. Data is not necessarily deleted immediately after account closure (see the Privacy Policy for details).
Article 8: Termination and Suspension of the Service
- 8.1 Suspension or termination by us: If a User violates these Terms, we may suspend their use of the Service or terminate their account without refund.
- 8.2 Termination by the User: Users may close their account at any time from the app settings. Note that canceling the Plus plan's auto-renewal must be done from the applicable store's management screen as set forth in Section 4.6.
- 8.3 Effect: Upon termination, the license to use the Service ends, and we handle account information in accordance with the Privacy Policy and applicable laws.
Article 9: Disclaimers
The Service is provided "as is." While we make reasonable efforts to provide it stably, to the maximum extent permitted by law we make no warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, non-infringement, absence of errors, or continuous operation. Failures or specification changes in third-party services (Supabase, OpenAI, RevenueCat, Apple App Store, Google Play, etc.) may make parts of the Service, or the purchase, renewal, or restoration of the paid plan, unavailable.
Force majeure
We are not liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including natural disasters, fire, flood, earthquake, power outages, telecommunications failures, war, terrorism, epidemics, or governmental actions.
Article 10: Limitation of Liability
Our total liability arising out of or in connection with the Service or these Terms shall not exceed the total amount the User paid to us during the 12 months preceding the event giving rise to the liability, except in cases of our willful misconduct or gross negligence. We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, or loss of data.
Article 11: Indemnification
Users shall defend and indemnify us against any third-party claims, losses, or damages (including reasonable attorneys' fees) arising from their violation of these Terms, their User Content, or their improper use of the Service.
Article 12: Changes to or Discontinuation of the Service
We may change or discontinue all or part of the Service with prior notice to Users (except in emergencies).
Article 13: Changes to These Terms
We may amend these Terms as necessary. If we make material changes, we will announce them by appropriate means. If a User continues to use the Service after a change, they are deemed to have agreed to the change.
Article 14: Notices and Contact
For inquiries about these Terms or the Service, please contact us via the contact form or by email (pasopaso.app@gmail.com).
Article 15: Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. In the event of any dispute concerning the Service, the court having jurisdiction over our location shall have exclusive jurisdiction as the court of first instance.
Article 16: Miscellaneous
Even if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to exercise a right does not constitute a waiver of that right. These Terms constitute the entire agreement between the User and us regarding the Service.
